GENERAL TERMS AND CONDITIONS OF CONTRACTING FOR THE HAWAIIAN TROPIC ONLINE STORE

1.- IDENTIFICATION OF THE PARTIES.

These General Terms and Conditions for the services offered on the website tienda.hawaiiantropic.es (hereinafter, the Website) are entered into by Imprex Europe S.L. (hereinafter, IMPREX), owner of said URL, with address at Pol. Ind. La Cantueña - Avda la Industria 22-24 Fuenlabrada - Madrid CP: 28947, no. 3 - 3rd floor; 28013 Madrid, with NIF: B28115764 and registered in the Mercantile Registry of Madrid, Volume 29.661, Folio 1, Section 8, Page M-533715, Entry 1, and with email address: customer@imprexeurope.com

And, on the other hand, the registered user or client, whose personal data is that which has been provided by them in the forms that IMPREX has made available on the Website or, where applicable, the User, in the terms established in the clause relating to definitions. The provision of personal data directly by users will be their sole responsibility, and they will be liable, at all times, for its authenticity and veracity.

The use of the Website requires the express acceptance by the client or user of each and every one of these General Conditions, as well as any particular conditions included for the use and/or contracting of specific services or purchase of products.

These General Conditions and Policies of the Website have been written in Spanish, and no version that may be found translated on the Internet or automatically provided by a search engine in any other language will be valid.

Every User who accesses the Website must be over 18 years of age with sufficient legal capacity to enter into contracts.

At any time, the interested party may save or print these conditions and the user is advised to do so.

If these General Conditions of contract are not accepted, the Client or User must refrain from accessing and/or using the services and/or acquiring the products offered by IMPREX, and must leave the Website.

2.- DEFINITIONS:

• User: Physical or legal person who visits the Website and uses its services without submitting any information request or purchasing the offered products.
• Registered User or Client: Physical person - over eighteen years of age - or legal entity, who completes the information request form(s) or proceeds to purchase the offered products, accepting the general conditions established by IMPREX through the Website.
• Contract: contains all the clauses included in this document, as well as all additional information describing each particular product available on the Website.
• Personal data: any information concerning identified or identifiable natural persons.
• Commercial content: information about products and prices, except for typographical errors or out-of-stock situations, which is displayed on the website will prevail over what is stated in this contract; for everything stated in all aspects not mentioned above, the provisions of these conditions will prevail.
• Cookies: a string of text installed on the hard drive of the User's computer that sends information to identify the user each time the User enters the Website. For more information, please consult our Cookie Policy ( https://tienda.hawaiiantropic.es/pages/politica-de-cookies ).
• Cart: List of products selected by the User for purchase. Its duration, while the purchase is not completed, is for the session.
• My account: Restricted access area for registered users where their personal data, placed orders, and history of shopping lists or saved favorite orders are identified.

 

3.- PURPOSE AND DEFINITION OF THE SERVICES OFFERED.

Through the Website, IMPREX enables clients or users to access and use the various services and content made available through this medium.

In this way, the Website serves as a tool for presenting and disseminating Hawaiian Tropic® services and products, also facilitating the online purchase of the products that are available at any given time.

IMPREX provides the User and/or Client with the following services through the Website:

• Corporate information.
• Product information.
• Online store service.
• Collection of information requests.
• Consultation of news and updates.
• Subscription to the newsletter.
• Offers or promotions for Users.
• My Account area.

Therefore, these General Conditions will apply to all services/products listed on the page.

The characteristics of each of these services/products are defined on the Website, as well as in these General Conditions.

IMPREX reserves the right to modify the circumstances and conditions of sale of its products, without prior notice to the user and provided that these do not affect the nature of the legal relationship maintained and these general conditions.

 4.- USERS AND SERVICES OFFERED ON THE WEBSITE:

The Website offers services open to the entire public that visits it. In addition, the possibility of purchasing the products available at any given time is offered.

The Website also offers free access services to all users who visit it, such as information about its products, news and updates.

Said users are only authorized to use the Website upon acceptance and compliance with the conditions set forth herein and must leave the Website otherwise. The use of these information services is free, as is the registration for the Newsletter service.

5.- PRODUCT PURCHASE PROCESS.

The user can place their orders using the services enabled on the Website, this process is carried out as follows:

 5.1. Product selection.

The Website offers the possibility to select the products you wish to purchase by adding them to the "Cart" area. The purchase option will only be enabled when the "Add to my cart" button appears next to the product information offered in the product category area.

Products added to the "Cart" will be kept for a period of 15 calendar days, regardless of whether the user is registered, so that they can resume the purchase process at a later time after their visit. The retention of this information is subject to the maintenance of cookies in their browser during that period.

 5.2. Registration.

On the Website, you can register as a Client, which can be done at the following times:

1. When you access the page by clicking on the "Register" button, a screen will appear asking for the following information: name, surname, an email address, a password, and the repetition of the chosen password. Filling in these fields is mandatory, so you cannot continue with the registration process if these fields are not completed. Then, you can enter your account details and register. You must also enter the necessary data for shipping your purchase.
2. You can also register at any time, once you have added products to your “Cart” and click the “Buy” button, at which point the Registration screen will appear. You must follow the process described in the preceding paragraph.
3. Once you have completed the registration process, this information will allow you to access future shopping sessions as a Client or consult your information. To do so, you only need to click on the “Login” button and enter your e-mail and password in the designated fields. You will then be identified on the Website.
4. If you are registered and do not remember your password, you can click on the "Forgot your password?" link, at which point you will be asked for the email address with which you registered and then you must click the "Send" button. Please check your email inbox at that moment and visit the provided link. You will be redirected to a section of the Website where you must enter a new password of your choice to renew it. IMPREX will under no circumstances have access to the passwords of registered users' accounts, which is why if you forget your password you must enter a new one.

5.3. Add products to "My Cart".

Click on the product category you wish to buy, enter the corresponding quantity of the desired product using your device's keyboard, once in the "Quantity" field, or click on the up or down arrows until you select the desired number of products, then click the "Add" button. Do not worry if you add more products than desired, as you can modify the quantity or cancel unwanted products in the "Cart" section. Also, you can modify your order before completing the purchase process.

5.3. Purchase process.

To place an order, you must add the desired products to your "Cart" and click the "Buy" button, then you will be asked to enter your user information if you have not logged in previously.

In any case, it is only possible to purchase packs of 4 products each, plus one travel-size product for each pack purchased. It will not be possible to purchase single products.

If you are not registered or are new to the store, you can create a Client account, as indicated in section 5.2 of these General Conditions.

Next, you will be asked for shipping information, which you can save associated with your account if you check the box indicating that you wish to save this information for future purchases. Likewise, the data you provided at the time of registration will appear. By clicking the "Continue to shipping method" button, if you have completed all the required fields, the shipping method information will appear.

Next, the "Shipping Method" information will be indicated, where the amount of shipping costs for processing your order will be identified, unless expressly stated as free in your order summary due to the destination of the shipment.

Then, if you click "Continue", you must choose the payment method to pay for your order.

Purchases will be paid for by credit or debit card. Accepted cards are: Visa, Mastercard and American Express. The amount of the purchases will be charged to the Client's account once confirmation of authorization from the payment gateway is received. In case of rejection by the financial institution, the order will be automatically canceled. If a purchase has been effectively made and the Client decides to cancel the charge made to their payment entity, they must compensate IMPREX for the damages and losses caused by said cancellation, provided that they have not incurred a return admitted in section 5.5.

To finalize your order, you must click "Continue" and a screen will appear with your order summary and the amount you must pay. Please review your order as you will not be able to modify it once you have clicked "Buy" after entering your credit or debit card details. You will then be connected to Stripe.com's secure payment system website.

On that screen, you will be asked for the following credit card details: cardholder's name and surname as printed on the card, card number, expiration date, and validation code. The payment process will end when you have entered the correct card details and click the "Pay" button.

Finally, the number assigned to your order will appear and the possibility to print the receipt of the same. We ask you to print a copy and keep it for your personal control.

You will also receive a summary of your order at the email address provided for registration.

Likewise, if you are a Registered User, you can access the status of your order and a list of placed orders in the "My Account" section.

The page is protected by a secure encrypted connection using the SSL encryption protocol, in order to protect users' personal data as effectively as possible.

5.4. Order/purchase confirmation message.

After completing the purchase process, you will receive the details and summary of your order at the email address you provided within 24 hours.

Likewise, if you are a registered User, you can view the summary of all placed orders in the "Account" section.

5.5. Delivery and withdrawal of services.

The delivery time for each item will depend on its availability and the destination to which it is shipped. The average delivery time for orders will vary between 24 to 48 hours for national shipments within peninsular territory and the autonomous cities of Ceuta and Melilla. In the case of the Canary and Balearic Islands, the delivery period may vary up to a maximum of 10 days. Saturdays, Sundays, and holidays are not included in the indicated periods. Deliveries will be made from Monday to Friday.

Orders with delivery to post office boxes will not be accepted. To optimize delivery to all parties, we ask the Client to indicate an address where the order can be delivered during normal business hours.

Orders will be delivered by IMPREX by its own means or through a transport agency, in which case a tracking number will be provided so you can track your order from the moment it is handed over to the carrier.

Orders will be delivered to the address designated by the buyer, therefore IMPREX assumes no responsibility when delivery cannot be made due to inaccurate or incomplete data provided or when delivery cannot be made due to the absence of the recipient. Notwithstanding the foregoing, IMPREX will take the measures required of a diligent merchant so that delivery can be made as soon as possible, to the satisfaction of both the sender and the recipient. When delivery must be made to addresses where there are restrictions on public access, IMPREX does not guarantee that it will be made directly to the recipient, the order being fulfilled and free of liability when the order has been made available to the recipient at reception or at a place that serves as access control.

During periods with special circumstances (designated dates such as Christmas, transport strikes, extraordinary events, etc.), shipments may experience some delay. IMPREX does not guarantee deliveries within the specified deadlines.

It is the recipient's responsibility to check shipments upon arrival, express observations, and make all claims deemed appropriate; they may even reject the package if it appears to have been opened or shows clear signs of damage. Such observations or claims must be communicated immediately to the transport company and to IMPREX by contacting our Customer Service. In case of breakage or loss of all or part of the order, it will be replaced.

If you wish to return a purchased product, you must contact our Customer Service at 695932573 or send an email to customer@imprexeurope.com, indicating the order number and the products you wish to return.

The maximum return period will not exceed 14 days from the receipt of the order, provided that the products subject to return are in perfect condition and have not been unsealed or tampered with by the Customer.

In the event that the reason for the return is not attributable to IMPREX, the Customer must bear the shipping costs for the return.

Provided that the Client has followed the return or order cancellation procedure and the requirements established in these General Conditions have been met, IMPREX will refund the price paid by the Client corresponding to the returned products, minus the return costs, within a maximum period of 7 days for debit cards and 30 days when payment was made by credit card, from the confirmation of arrival at the warehouse.

Partial returns of an order will result in partial price refunds. In the event of a partial return of products and the modified order amount leads to the application of shipping costs, these will be deducted from the amount subject to refund by IMPREX. In all cases, 1.4% + €0.25 of the total order amount will be withheld for payment system management fees.

IMPREX will process the refund order through the same payment method used by the customer for the purchase of the products, within the maximum period indicated from the confirmation of arrival of the returned order at the warehouse. The application of the refund to the customer's account will depend on the card and the issuing entity. The refund period will be up to 30 calendar days for credit cards.

In any case, returns must meet the following requirements:

• The returned product must be in its original condition, retaining, as far as possible, the original packaging and labeling.
• The same box in which the shipment was made must be used for the return.

 5.6. Order modification.

If, after placing your order, you wish to modify it, you can contact our Customer Service at 695932573 or send an email to customer@imprexeurope.com indicating the modification you wish to make.

In the event that the modification involves the cancellation of products purchased from your cart, and this modification generates shipping costs, these will be deducted from the amount to be refunded by IMPREX.

 6.- MY ACCOUNT

The restricted access area is configured as the area of the Page intended for the management of a Registered User's private account area.

In this space, the user can access information related to their account and, if applicable, information and editing of placed orders, as well as managing the newsletter subscription.

The cancellation or deactivation of the account does not imply the cancellation of effective purchases made. If you request to cancel your account and have active orders, for convenience and to facilitate tracking of your orders, we recommend keeping the account active until you have received your order. However, it is possible to print your order receipt and have a copy of it at the email address provided.

7.- CUSTOMER SERVICE

Likewise, for any communication you wish to send us in writing, you can send us an email to customer@imprexeurope.com or by sending it to IMPREX -Customer Service- Pol. Ind. La Cantueña - Avda la Industria 22-24 Fuenlabrada - Madrid CP: 28947.

Claims related to placed orders will be processed as soon as possible and, in any case, within a maximum period of one month from the submission of the claim.

8.- PRICE OF PRODUCTS OFFERED AND TAXES

The services provided by the Page to the general public are free and merely informative, so they do not require any action to cease, only the user's mere will not to visit the page. This is not the case for products that indicate a price or that are not available for sale at that time.

The indicated prices for each product are total (VAT included) and are shown in euros, unless there is a typographical error, on the date the order was placed. Detailed prices do not include participation in shipping costs, unless free shipping is indicated depending on the destination determined by IMPREX or a temporary promotion for free shipping is activated. Participation in shipping costs is understood to be exclusive of taxes. Transport costs are always listed separately, detailed prior to the confirmation of your order/purchase.

The prices and conditions displayed are valid at all times, and are only valid during the open session. In the order confirmation information, prior to the buyer accepting the transaction, the prices of each of the selected items, the specific delivery costs that, if applicable, will apply to the transaction, and any promotions or discounts that, if applicable, apply, are clearly specified.

IMPREX reserves the right to make, at any time and without prior notice, any modifications it deems appropriate, including updating products and prices daily, depending on new developments and variations in product and service characteristics.

9.- WARRANTY FOR PURCHASED PRODUCTS

The Customer may exercise the product warranty according to current regulations on consumer product warranty.

The warranty does not include deficiencies caused by negligence, blows, improper use or handling, nor perishable materials or products subject to an expiration date or indicative consumption date, subject to wear and tear from normal use or consumption. Products handled by the Customer or any other person not authorized by the manufacturer are excluded from the warranty. Among other cases, the Customer will not have the right to exercise the product warranty and, consequently, the warranty will not apply:

1. a) if any of the product warranty data provided or the purchase receipt for the products are modified, altered, or replaced.
2. b) if the product is tampered with or unsealed.
3. c) if the purchase receipt and delivery note for the products are missing.

To make use of the warranty, it is essential to keep the purchase receipt and the delivery note for the products. In the event that the manufacturer grants additional commercial warranties, it will be necessary to keep the corresponding warranty certificate to exercise them.

The Customer must always follow the informative leaflet and/or the instructions on the label for the correct use of the product and all information regarding the warranty.

 10.- SECURITY

IMPREX has implemented the necessary technical and organizational measures to prevent the loss, misuse, alteration, unauthorized access, and theft of personal data that interested parties may provide as a result of accessing the different sections of the Page, applying security measures in accordance with the risks to which they are exposed.

The Page has an SSL Certificate backed by Let's Encrypt, with the purpose of guaranteeing security in data transmission between your browser and our Page.

IMPREX is aware of the importance of personal data privacy and has therefore implemented a data processing policy aimed at maximum security in its use and collection, guaranteeing compliance with current regulations on the matter and configuring said policy as one of the basic pillars in the entity's lines of action.

• Opinions that include sexually explicit comments, incitement to hatred, prejudiced comments, threats, or personal insults will be rejected.
  
  
• Opinions describing unhealthy activities or describing illegal activities will be removed.
  
  
• Make sure your opinions are relevant and helpful. Keep in mind that your opinion will be read to understand what their experience with the product might be like.

13.- RESPONSIBILITIES:

13.1. Of IMPREX :

IMPREX will not assume any liability arising from, but not limited to:

• The quality of the service, access speed, correct functioning, availability, or continuity of operation of the Page.
  
  
• Damages that may be caused to the user's equipment by the use of the Page.
  
  
• Failure to comply with the law, morality and generally accepted good customs, or public order as a result of the transmission, dissemination, storage, availability, reception, obtaining, or access to content.
